Supreme Court Review for the Week of February 8, 2016

The Wyoming Supreme court ruled on four cases this past week. Three of the cases were rolled into one decision concerning Sky Harbor and the Cheyenne Airport. The other was a workers compensation case, .

Sky Harbor Vs. Cheyenne Regional Airport Board

The case was heard by Justice Burke, Justice Hill, and Justice Kautz. Justice Fox and Davis recused themselves from hearing the case and Judicial District 4 Judge Fenn and Judicial District 8B Judge Brooks were ordered to hear the case. The docket numbers for these cases are S-15-0143, S-15-0144, and S-15-0145.

    Judge Brooks writes:

These three consolidated appeals are the culmination of years of litigation between
the parties. They involve a tangled web of claims and allegations between the Appellant
(“Sky Harbor”) and the Appellee (Cheyenne Regional Airport or “Airport”). At the heart
of the controversy is Sky Harbor’s alleged failure to pay rent to the Airport. The focus of
Sky Harbor’s defense is that the District Court lacked subject matter jurisdiction to
decide any of the cases now on appeal. The District Court disagreed and generally found
in favor of the Airport in all three cases. We affirm.

Charley Collins Vs. COP Wyoming LLC, and Roger Ross
The case was heard by the Justices of the Wyoming Supreme Court. The Docket number is S-15-0098.

    Justice Fox Writes:

Appellant Charley Collins appeals the order dismissing his claim for negligent
infliction of emotional distress against his employer, COP Wyoming, LLC, and his coemployee,
Roger Ross. Charley alleged he suffered emotional injuries after he witnessed
the death of his son, Brett Collins,1 who was also an employee of COP Wyoming, and
whose death was covered by Wyoming worker’s compensation. The district court found
that the claims of the father were derivative of the covered death of the son and were
therefore barred by worker’s compensation immunity. Charley appeals and we reverse.
